Whiscret Terms of Service

These Terms are an agreement between you and Talha Orak ("we", "us"), an individual developer based in Türkiye, about your use of Whiscret at https://whiscret-production.up.railway.app and any domain we later move to. Please read them together with our Privacy Policy and Cookie Policy. By creating an account or sending a question, you agree to these Terms.

1. What Whiscret is
Whiscret is an anonymous question-and-answer profile app.
- You create a profile with a username and, if you like, an avatar, a short bio and links to your Instagram, TikTok, YouTube or website.
- Anyone, signed in or not, can send a question to a public profile and can choose to send it anonymously.
- The profile owner decides which questions to answer. Answered questions are public: they appear on the owner's profile and in Whiscret's public feed. Unanswered questions are visible only to the owner.
- Optional extras: link a Spotify account to show what you are listening to (now playing, recently played and your public playlists), link an X (Twitter) account to cross-post your answers, and post "moods" that stay on your profile for 24 hours.
- Realtime in-app notifications, plus an email-notification setting you control.
Whiscret is free today. Section 11 explains what happens if we add paid features.
2. Who can use Whiscret
- You must be at least 15 years old. Turkish Law No. 7578 (in force from 1 November 2026) prohibits social network services for children under 15, and we apply this age limit to everyone, wherever they live.
- If you live in the European Union or the EEA and are under 16, you may use Whiscret only if a parent or guardian agrees to it.
- You must be at least 18 to use any paid feature we may add later.
- You confirm your age when you sign up, and we keep a record of that confirmation. We may ask for age verification where the law requires it. We close the accounts of people who do not meet these age rules. If you believe a child under 15 is using Whiscret, write to talhaorak@gmail.com.
- You may not use Whiscret if we have previously suspended or removed your account for breaking these Terms.
3. Your account
- You sign up with an email address and a password (handled by Supabase Auth) and confirm your email address. Keep your password secret. Everything done through your account is your responsibility, so tell us straight away at talhaorak@gmail.com if you think someone else has used it.
- You choose your username. It must not impersonate another person or organisation, and it must not be offensive or misleading. We may change or reclaim a username that breaks these rules or infringes someone's rights.
- One person, one account. Do not create accounts with automated tools or sell, rent or share an account.
- You can delete your account at any time in Settings, or by emailing us. The Privacy Policy explains what is deleted and when.
4. Asking questions and anonymity
- Anyone can send a question to a public profile. Before sending, you can choose to ask anonymously.
- The recipient sees your question and, if you are signed in and did not choose anonymity, your username. When you ask anonymously, the recipient never sees who you are.
- To keep Whiscret safe, every question is stored with abuse-prevention data: a keyed hash of your IP address (which cannot be turned back into the address), your country code and a shortened version of your browser identifier. If you are signed in, your account ID is also stored with the question even when you ask anonymously. This data is used only to prevent spam and abuse and to meet legal obligations. It is never shown to the recipient or to other users.
- Our anonymity promise: we never reveal the identity of an anonymous asker to the recipient or to any third party. The only exception is when the law requires it or a competent authority (for example a court or prosecutor acting under Turkish or EU law) orders it.
- Once you send a question, you cannot edit or take it back inside the app. The owner may answer it, ignore it or delete it. If you want us to remove a question you sent, email talhaorak@gmail.com.
- Anonymity is not a licence to behave badly. You remain responsible for what you write, and Section 7 applies in full.
5. Answering and publishing
- You decide which questions on your profile you answer. When you answer, the question and your answer become public on your profile and in the feed.
- You can delete an answered question at any time; it is then removed from your profile and from the feed.
- If you have linked an X account and choose to cross-post an answer, Whiscret posts that answer to X from your account. Content posted to X is governed by X's rules. Deleting an answer on Whiscret does not automatically delete the post on X; you can delete it there.
- Moods are shown on your profile for 24 hours.
- Public means public. Search engines may index your profile and answers, and other people may copy, screenshot or share them. Think before you publish.
6. Your content and the licence you give us
- You own what you write and upload (questions, answers, moods, bio, avatar). We do not claim ownership of it.
- So that we can run Whiscret, you give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and technically adapt your content (for example resizing an avatar or generating a link preview) for the purpose of operating and displaying the service, including in the public feed and in notifications.
- When you send a question to another user, you also allow that user to publish your question together with their answer on Whiscret and, if they use cross-posting, on X.
- This licence ends when you delete the content or your account, except for copies that remain for a limited time in backups, copies other people have already shared, and content already cross-posted to X.
- You promise that you have the right to post your content and that it does not break Section 7.
- If you send us ideas or feedback, we may use them without any obligation to you.
7. Acceptable use
Do not use Whiscret to post, send or do any of the following:
- Harassment, bullying, threats or intimidation of any person.
- Hate speech: attacking people because of their ethnicity, national origin, religion, gender, sexual orientation, disability or similar characteristics.
- Sexual content involving minors, in any form. We have zero tolerance for this and report it to the authorities.
- Doxxing: publishing someone's private information (home address, phone number, ID numbers, private images or messages) without their consent. This includes sharing intimate images without consent.
- Impersonating a person, brand or organisation, or misrepresenting who you are.
- Spam, scams, mass unsolicited messages or commercial promotion we have not agreed to.
- Attempts to identify an anonymous asker, whether by technical means, by tricking or pressuring people, or by asking others to do so.
- Content that is illegal under Turkish or EU law, including content that violates personality rights, incites violence, promotes terrorism, infringes copyright or trademarks, or encourages self-harm.
- Interfering with the service: bypassing rate limits or security measures, scraping, automated access without our permission, uploading malware, or accessing another person's account.
8. Reporting and moderation
- To report content or a user, email talhaorak@gmail.com with a link to the profile or content and a short explanation of the problem. An in-app report or block feature is not available yet; we will update these Terms when it is.
- If you believe content on Whiscret violates your personality rights, you may notify us under Article 9 of Turkish Law No. 5651. If you live in the EU, you may notify us of content you consider illegal under the Digital Services Act. We review notices promptly and tell you what we decided where the law requires it.
- We do not check content before it is published. Users are responsible for what they post. We act when we become aware of a problem.
- If content or behaviour breaks these Terms or the law, we may remove or hide the content, restrict features, suspend or terminate the account, and, where the law requires, preserve information and pass it to the competent authorities. We tell the affected user the reason unless the law prevents it or doing so would put others or the service at risk.
- If you disagree with a moderation decision, reply to our email and explain why. We will look at it again.
9. Linked services: Spotify and X
- Linking is optional and done through each service's own sign-in (OAuth). We store the resulting access tokens on our server only so we can fetch data from, or post to, that service for you. You can unlink at any time in Settings; we then delete the tokens.
- Spotify: we show your now-playing track, recently played tracks and public playlists on your profile. That information belongs to Spotify and is subject to Spotify's terms. We keep only what we need to display it: the connection tokens and your Spotify account identifier.
- X: when you choose to cross-post an answer, we post it to X from your account. Your posts on X are subject to X's rules.
- Spotify and X are separate companies with their own terms and privacy policies. We are not responsible for their services, and they may change or withdraw the access that makes these features work.
10. Notifications and email
- Whiscret shows realtime notifications inside the app.
- You can turn email notifications on or off in Settings.
- We do not send marketing emails. We may still send emails that are necessary for your account, such as email confirmation, password reset, security alerts and notices about changes to these Terms.
11. Paid features (not available yet)
Whiscret has no paid features today. If we add any:
- They will be available only to users aged 18 or over.
- Before you buy, we will show you the price, what you get, how long it lasts, whether it renews and how to cancel, as required by Turkish consumer law (Law No. 6502 and the Distance Contracts Regulation) and EU consumer law.
- As a consumer you normally have 14 days to withdraw from a distance purchase. For digital content or services that start immediately at your request, the right of withdrawal may end once performance has begun, but only if you expressly agreed to this and acknowledged losing the right beforehand.
12. Our intellectual property
The Whiscret name, logo, design and software belong to us or our licensors. You get a personal, non-transferable right to use the app under these Terms. Do not copy, modify, or reverse-engineer the service except where the law allows it.
13. Suspension and termination
- You can stop using Whiscret and delete your account at any time.
- We may suspend or terminate your account if you break these Terms, if the law requires it, if your account poses a risk to other users or to the service, or if we discontinue Whiscret (in which case we will give reasonable notice where possible).
- When an account ends, your data is handled as described in the Privacy Policy. Sections that by their nature should survive (for example content licences for already-shared copies, liability and governing law) continue to apply.
14. Changes to Whiscret and to these Terms
- Whiscret will change over time. We may add, change or remove features.
- If we make material changes to these Terms, we will tell you at least 15 days in advance by an in-app notice and/or email, unless a change is needed immediately for legal or security reasons. If you do not agree, delete your account before the change takes effect. Using Whiscret after that date means you accept the new Terms.
15. Disclaimers
- Whiscret is a free service provided "as is" and "as available". We do not promise that it will always be available, error-free or secure, and we may interrupt it for maintenance.
- Content on Whiscret comes from users. It is not ours, and we do not endorse it.
- We built Whiscret so that recipients never see the identity of an anonymous asker. We cannot, however, control what you reveal about yourself inside a question, or stop others from guessing.
- Nothing in this section limits rights you have under mandatory consumer law.
16. Liability
- We are fully liable for damage we cause intentionally or through gross negligence, for death or personal injury, and in any other case where the law does not allow liability to be limited.
- In all other cases we are liable only for breach of an essential obligation of these Terms and only for damage that was foreseeable when you started using Whiscret. We are not liable for content posted by users or for third-party services such as Spotify or X.
- You are responsible for your content. If someone brings a claim against us because of your content or your breach of these Terms, you will compensate us for the resulting loss to the extent you are responsible for it under applicable law.
17. Governing law and disputes
- These Terms are governed by the laws of the Republic of Türkiye. Disputes are heard by the competent courts of Türkiye. If you are a consumer in Türkiye, you may also apply to the Consumer Arbitration Committee or the Consumer Court at your place of residence.
- If you are a consumer in the EU or EEA, this choice of law does not take away the protection of mandatory rules of the country where you live, and you may bring a claim before the courts of that country.
- We do not take part in alternative dispute resolution schemes for consumers. Please contact us first at talhaorak@gmail.com; most problems can be solved directly.
18. General
- These Terms, the Privacy Policy and the Cookie Policy are the whole agreement between you and us about Whiscret.
- If any part of these Terms is found invalid, the rest continues to apply.
- We may transfer this agreement to someone who takes over Whiscret; we will tell you if that happens. You may not transfer it.
- If we do not enforce a provision, that does not mean we have given it up.
- These Terms exist in English and Turkish. For users in Türkiye the Turkish version prevails if the two differ; for everyone else, the English version prevails.
